SELLERS OBLIGATIONS

THIS SECTION EXPLAINS THE OBLIGATIONS OF THE SELLER USING A PASSPORT REALTY MLS FLAT PRICE LISTING


Seller agrees to notify Broker within 24 hours after acceptance of a contract


Seller agrees to notify Broker within 24 hours of closing the property.  Seller agrees to include Buyers Real Estate Agent’s name and identification number, if appropriate, and the actual selling price. 


SELLER MUST REVIEW THE FOLLOWING TERMS AND CONDITIONS – BY CHOOSING TO CONTINUE, YOU, AS THE SELLER, ARE ACKNOWLEDGING THAT YOU HAVE READ AND ACCEPT THESE TERMS AND CONDITIONS.


Seller desires to use the services of Passport Realty Inc to help Seller(s) sell the listed property. Seller(s) understands that Passport Realty Inc is offering services on a specific price for specific services and that only the specific services described in this agreement are being provided by Passport Realty Inc. 


Services not explicitly described are not provided under this agreement. 


1.5 - 2 hours of professional consultation services are required to complete the paperwork and photography to list the property on the MLS. 


Passport Realty Inc will not provide any legal services to the Seller(s).


Seller(s) agrees to show the property to prospective buyers, and Seller(s) agrees to allow other real estate agents to show the property to prospective buyers.  If such a buyer purchases the property with the use of a real estate agent, the Seller(s) agrees to pay the commission agreed upon in the MLS Listing Agreement.


Seller(s) agrees that Passport Realty Inc shall have no liability for any keys placed in a Key Lock Box, if any, and that Passport Realty Inc shall have no liability for losses or damages suffered by Seller due to the showing of the property by other brokers or their agents.


Seller(s) agrees that Passport Realty Inc shall not be liable for maintenance to the property. 


Seller(s) agrees that Seller(s) will be responsible for all costs related to marketing or showing the property other than those costs specifically covered by this agreement.


Once payment has been made Seller understands that Passport Realty Inc will incur costs in time and expense related to the preparation of information and preliminary input of information into the MLS system.


Seller(s) may cancel this agreement at any time and may cancel the MLS Listing at any time; providing the listed property is not under contract, however, any fees that have been paid are not refundable. For 1% Full Representation Listings, a cancelation fee of the up to the amount of the contract commission fee, may be required for cancellation during the contract period.


Seller(s) agrees that if this agreement is cancelled prior to the sale of the property and that any fees are due to Passport Realty Inc related to services performed as a result of this agreement, all such fees for such services that are outstanding and unpaid shall be paid immediately upon cancellation of this agreement.


Seller(s) agrees to review all information on the MLS Listing Data Input Form for accuracy and further agrees to review the information that is shown on the MLS Listing websites for accuracy.  In the event of inaccuracies in listing information Seller(s) agree to immediately notify Passport Realty Inc, via email, to advise Passport Realty Inc of what changes to the listing information are required.


Seller(s) agrees to verify the accuracy of all listing data by reviewing the link to the MLS Listing submitted by Passport Realty Inc to the Seller(s). Changes to data, other than changes to Status or Price, that are requested by Seller subsequent to listing on the MLS may be requested twice per 30 day period.  Additional changes may be subject to additional fees.


Seller(s) agrees to indemnify Passport Realty Inc for any expenses that arise as a result of inaccurate information that was listed on the MLS system and which the Seller(s) reviewed for accuracy. 


Seller(s) ackowledges that Passport Realty Inc  may be contracted to provide professional services related to the negotiation and closing of a contract for purchase of the Seller’s property listed with Passport Realty Inc.  These additional services are available through the use of the Full Representation Option offered by Passport Realty Inc. 


Seller(s) Acknowledgement of Responsibility


As the Seller(s) of the property I (we) hereby specifically acknowledge the following:


1) Contracts and Related Documents


a. By choosing to list property on the MLS system Seller(s) agree to provide Passport Realty Inc with a copy of the Final contract of sale from ANY Buyer that has been signed by the Seller(s).


b. Seller(s) MUST provide Passport Realty Inc with a copy of any contract signed by Seller(s) within 48 hours of signing (this is what the MLS requires so it goes to Pending Status). Failure to comply with this requirement constitutes a voluntary termination of the Listing Agreement between Seller and Passport Realty Inc and also constitutes permission for Passport Realty Inc to charge Seller an additional fee of $200 for  termination of the Listing. The $200 fee will ONLY be charged IF SELLER DOES NOT provide a copy, via fax transmission or via email, if above documents are scanned and emailed in its entirety, of the signed contracts within 48 hours of signing.


c. Seller(s) MUST provide Passport Realty Inc with a copy of the HUD-1 Statement signed by Seller(s) within 48 hours of signing. This document is required to close the MLS listing and change its status to Sold.  Seller will include the Buyers Real Estate Agent’s ID # if a real estate agent was involved in the transaction. Failure to comply with this requirement constitutes a voluntary termination of the Listing Agreement between Seller and Passport Realty Inc and also constitutes permission for Passport Realty Inc to charge Seller an additional fee of $200 for  termination of the Listing. The $200 fee will ONLY be charged IF SELLER DOES NOT provide a copy, via fax transmission or via email if above documents are scanned and can be emailed in its entirety, of the Hud-1 within 48 hours of signing.


2) Data Entry Errors

a. As the Seller(s) of the Property you agree to carefully review the data that we provide to the MLS for accuracy immediately upon receipt of the Full Agent Report.

b. If any information on the Full Agent Report is incorrect you agree to notify us within 2 business days.


3) Indemnification

a. As Seller(s) of the Property being placed on the MLS by Passport Realty Inc you agree to indemnify Passport Realty Inc for any and all expenses, penalties, fines and costs incurred by Passport Realty Inc, without limit, as a result of your failure to abide by the your responsibilities as detailed in this agreement.

In the event of any dispute as to the duties of the parties under this agreement Seller(s) agree to submit to binding arbitration in Duval County with an arbitrator selected by mutual consent of the parties hereto. This agreement will be subject to venue in Duval County, Florida in the event of any dispute by the parties hereto.
